EASTHAM BOARD OF HEALTH MEETING
THURSDAY, AUGUST 29, 2013 AT 3PM
Present: Dr. James Taylor, Chair, Dr. Martin Haspel, Beverly Knox, Dr. Joanna Buffington, Jane Crowley, Susan Barker

Dr. James Taylor reminded everyone regarding this.
Dr. James Taylor advised that the Board of Health will be at Windmill weekend. They will provide educational materials, information and handouts to people. Please stop by and visit with the Eastham Board of Health.
Jane Crowley provided the following updates:
- KI (Potassium Iodide) Distribution Program – the Health Department has a supply of these pills for distribution to residents. The purpose of this program is to provide these pills to residents in the event of an issue at the Plymouth Nuclear Plant. The KI pills will saturate the thyroid gland to prevent it from taking in any radioactive iodine. The pills should not be taken until advised by emergency management. NOTE: The KI pills will not protect any other glands.
- The Water Quality Management Program for area 3 has begun. This area covers the southern portion of Eastham. Water vials are available at the Health Department in the Town Hall, the Library and the Natural Resources Department. Once the sample is taken, the vials can be returned to these same locations.
- Flu Clinic planning has begun. We will host 2 clinics as follows:
- October 10, 2013 – Town Hall – 1PM to 4PM
- Registration will be on line and a link will be on the Town of Eastham website
- October 17, 2013 – Council of Aging – 9AM to 12PM
- Registration by calling the Council of Aging
- The Cape Cod Commission is busy this summer regarding Wastewater Management. There is a link on the Town of Eastham if you are interested in additional information.
- Pond treatment planning for the remediation of Great Pond has begun. The results have been good concerning the treatment of Herring Pond that was treated last year. This is evident by the clarity testing that has shown that the clarity was ½ meter last year and was 4.7 meters this year.
- Monitoring of the Landfill has continued. The Town of Eastham has been named as a potential responsible party in this situation. A new consulting firm has been hired due to the size of the project and the analytical needs for it. The transition to the new consulting firm has begun.
- Dr. James Taylor noted that the cleanliness of our water is our number one issue. The perculation rate of our land is very quick so filtration is not good. This is due to our sandy land.
- Dr. James Taylor also noted that Flu shots are very important and he encourages everyone to get one.

John Schnaible, Coastal Engineering Company, Inc. presented.
The leach pit at this property has failed for the second time and needs to be upgraded. A review of the property has proposed the best location for the leach field with variances required to the property sidelines, top of coastal bank and top of S.A.S. and D box.
Dr. Joanna Buffington made the motion to approve the plan dated July 11, 2013 and Revised August 2, 2013 with the following conditions:
- No increase in design flow be allowed
- Any increase in habitable space would require abutter notification and Board of Health review.
- Deed restriction for 4 bedroom use to be recorded with the Barnstable Registry of Deeds and a copy provided to the Eastham Health Department

David Lajoie, Felco, Inc., presented. Dorcas Gill and Mark Herman, owner’s son-in-law also attended.
The current cesspool has failed and requires an upgrade. The upgrade will require 1 variance of the S.A.S. to the property line. The original home on this property was 4 bedrooms when it was built in 1932. Two bedrooms were on the first floor and two on the second floor. In 1980, an addition was built which included a garage and pool room. The Health Department conducted a site inspection and determined the number of bedrooms to be two. The owner would like the Board to declare the home as a 3 bedroom home.
A discussion took place regarding the size and the environmental sensitivity of this lot. Under today’s standards, the lot size would provide for a 1 bedroom house. With an Innovative Alternative system (I/A), it would provide for 2 bedrooms based on the 6,666 sq. ft. per bedroom requirement for an I/A.
Dr. Joanna Buffington made the motion to approve the plan dated July 12, 2013 and revised per discussion and approval with the following conditions:
- No increase in design flow be allowed
- Any increase in habitable space would require abutter notification and Board of Health review.
- Deed restriction for 2 bedroom use to be recorded with the Barnstable Registry of Deeds and a copy provided to the Eastham Health Department
- Revise July 12, 2013 plan to 2 bedroom flow for design - (copy of revised plan dated August 30, 2013 has been received)

It was noted that the Abutter Notification was incorrect in both time and meeting location. Therefore, the variance could not be heard.
Dr. Martin Haspel made the motion to continue the hearing to September 12, 2013 at 2PM at the Orleans Town Hall, 19 School Road, Orleans, as a joint meeting with the Orleans Board of Health.

Jason Ellis, J.C. Ellis Design, presented.
Due to erosion, the plan is to lift the house onto a pile foundation, remove the current basement, change one of the current bedrooms into a utility room for the washer/dryer and furnace, and add a bedroom to the end of the house. A new I/A system is also planned as the current septic system is an old Title 5 system with a 750 gallon tank and the S.A.S. only 10 feet above ground water.
Beverly Knox made the motion to approve the plan dated August 2, 2013 and revised August 16, 2013 with the following conditions:
- Routine water quality test results be provided of proposed well location to assure potability
- No increase in design flow be allowed
- Any increase in habitable space would require abutter notification and Board of Health review.
- Secondary treatment and monitoring under general use approval conditions per DEP regulations including testing quarterly (or 2 times per year for seasonal use) for total nitrogen, BOD, TSS, Nitrate-nitrogen not to exceed 19 mg/L. After 2 year period of time, reduction of testing could be requested to the Eastham Board of Health (EBOH) by the owner.
- Operation and maintenance agreement to be submitted to EBOH. Operation and maintenance agreement to be required for life of the system. Operator to report results via Carmody Data Base provided through Barnstable County Health or directly to the Eastham Health Department if not available.
- Deed restriction for 5 bedroom use and use alternative technology requirement to be recorded with the Barnstable Registry of Deeds and a copy provided to the Eastham Health Department
Designer to verify proper operation of the system prior to issuance of Certificate of Compliance
- Subject to Conservation Commission approval

- Busse Extension 35 Oak Leaf Road M-5 P-35
Busse Green Technologies, Inc. has requested another 60 Day extension of the DEP as they continue to respond to the Statement of Technical Deficiencies issued by them on December 4, 2013. The EBOH approved this project on August 30, 2012 subject to DEP approval. Therefore, the EBOH must review the option to grant an extension to their approval in 2012.
Dr. James Taylor made the motion to grant an extension to November 30, 2013.
Beverly Knox seconded the motion.

Jane Crowley was contacted by a resident as they had heard that NSTAR planned to spray in Eastham. Jane contacted NSTAR and confirmed with them that NSTAR is not planning on spraying in Eastham.
